These Terms of Use ("Terms") constitute a legally binding agreement between you and Big Mike LLC ("Big Mike," "we," "us," or "our") governing your use of our website, iOS application, and SMS/iMessage services (collectively, the "Services").
By accessing or using any part of the Services, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Disclaimer, all of which are incorporated by reference. If you do not agree to all of these Terms, you may not use the Services.
Where the app presents these Terms during sign-up, you accept them by checking the box confirming that you have read and agree to these Terms of Use, our Privacy Policy, and our Disclaimer, each of which is incorporated by reference. We keep a record of the date, time, and account associated with your acceptance.
If we materially change these Terms, we will notify you in the app or by text and, where required, ask you to accept the updated Terms again; where re-acceptance is not required, continued use of the Services after notice constitutes acceptance. The version of these Terms in effect at your most recent acceptance governs your use from that date forward.
You must meet all of the following requirements to use Big Mike:
By registering, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts of users who misrepresent their eligibility.
Big Mike provides AI-assisted sports betting analysis, expected value (EV) picks, injury alerts, line movement notifications, and related content delivered via iMessage and SMS. The Big Mike iOS app mirrors and extends that service: it includes odds boards comparing sportsbook prices with per-book handoff links, Big Mike's public picks record, a synced-bet ledger for sportsbook accounts you choose to link, a fantasy football analysis hub, in-app news and analysis articles, a home-screen widget, and account, squad, and subscription management.
Big Mike is an information and analysis service only. We do not operate as a sportsbook, accept wagers, or facilitate gambling transactions. All betting activity occurs on third-party platforms not affiliated with Big Mike LLC. Some odds boards also display prediction-market prices (Kalshi and Polymarket) as reference probabilities; no trading happens in the Services, and tapping such a row hands you off to that venue's own app or website under that venue's terms.
Linked accounts. If you link a sportsbook account, you authorize Big Mike to receive, through SharpSports (a read-only account-sync service), your bet history and account balances for that account on an ongoing basis until you unlink it. You represent that any account you link is your own. Sportsbook credentials are provided by you directly to SharpSports and never touch Big Mike's servers. If you link a fantasy league (Sleeper or ESPN), you authorize us to read league and roster data for that league; we never write anything back to fantasy platforms. Big Mike is not responsible for the acts, omissions, or availability of any sportsbook, fantasy platform, or account-sync provider.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without liability to you.
This consent is a condition of the service. Opting out of SMS/iMessage will suspend pick delivery. You may re-enable messaging at any time through the app. Your consent to receive messages is recorded at the time of account creation and stored securely.
Beyond STOP, the app gives you direct frequency controls: quiet hours (a nightly window during which Big Mike will not text you), per-category alert toggles and radar preferences, and a pause control. Daily message volume is also capped per member.
Big Mike membership is an auto-renewing subscription purchased through Apple In-App Purchase, offered monthly and annually. Current prices, introductory and promotional offers (including a 7-day free trial for accounts that have not used one, discounted first-year annual pricing, and win-back offers for returning members), squad discounts, and any boost add-ons are shown in the app at the time of purchase; the price on Apple's payment sheet is the price you pay.
All billing is handled by Apple. You authorize Apple to charge your payment method on a recurring basis. You can manage or cancel your subscription at any time through your Apple ID account settings, and cancellation takes effect at the end of the current billing period. We do not issue refunds for partial subscription periods, except as required by applicable law or Apple's policies.
Prices may change with notice. We will notify you before any price changes affect your subscription.
The Squad program allows subscribers to invite others to join a shared group for discounted pricing. By participating in a squad:
Group chats and non-user participants. If you add Big Mike to any group chat — an existing thread or a new one, whether or not it is a squad crew chat — you are solely responsible for who is in that chat. By adding Big Mike to a group chat, you represent and warrant that every participant either (a) is an existing Big Mike user, or (b) has given you their express permission to be included in a chat in which Big Mike, an automated messaging service, will send messages. Where a participant is not an existing Big Mike user, it is your responsibility — not Big Mike LLC's — to obtain that permission before adding Big Mike to the chat.
You assume full responsibility for any third-party outcome that results from your adding Big Mike to a group chat that includes individuals who are not existing Big Mike users. This includes any complaint, dispute, claim, demand, regulatory action, or lawsuit brought against Big Mike LLC by or on behalf of such individuals — including, without limitation, claims under telephone-consumer-protection, privacy, or anti-spam laws — arising from messages sent in that chat. If any such legal action is taken against Big Mike LLC, you agree to bear the full financial responsibility for that action, including the costs of defense, reasonable attorneys' fees, settlements, judgments, damages, and any penalties or fines, as further described in the Indemnification section of these Terms.
All content, features, branding, analysis methodology, "Big Mike's Read" system, and intellectual property associated with the Services are owned by Big Mike LLC and protected by copyright, trademark, and other intellectual property laws.
Third-party team names, logos, uniforms, and other marks that appear on the site remain the property of their respective leagues, teams, and institutions; see the Fan Content and Trademarks section of our Disclaimer for how that content is used.
You are granted a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial purposes. You may not:

Violation of these prohibitions may result in immediate termination of your account without refund.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BIG MIKE LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PICKS OR ANALYSIS WILL RESULT IN PROFIT.
Sports betting involves substantial risk of financial loss. Past performance of picks is not indicative of future results. Big Mike provides analysis and information only -- we are not responsible for any betting decisions you make or losses you incur.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIG MIKE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
In no event shall our total liability to you for all claims exceed the amount you paid to Big Mike LLC in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Big Mike LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law; (d) any betting or financial decisions you make based on information from the Services; or (e) your adding Big Mike to any group chat that includes individuals who are not existing Big Mike users, including any claims brought by or on behalf of those individuals, or by any regulator, arising from messages sent in that chat.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction in those courts.
Notwithstanding the foregoing, Big Mike LLC may seek injunctive or equitable relief in any jurisdiction to protect its intellectual property rights.
Informal resolution first. Before filing any claim, you agree to contact us at help@bigmike.ai and give us 30 days to work with you toward an informal resolution. Most issues get fixed this way.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English on an individual basis. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small claims court.
Class action waiver. YOU AND BIG MIKE LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims may be brought only in an individual capacity.
Opt-out. You may opt out of this arbitration provision by emailing help@bigmike.ai with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms.
You may stop using the Services and cancel your subscription at any time through the App Store (Account → Subscriptions) or by texting STOP to end messaging.
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, misrepresented your eligibility, abused the Services, or where required by law. Upon termination, your right to use the Services ceases immediately; fees already paid are governed by Apple's refund policies.
Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law — survive.
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Big Mike LLC regarding the Services and supersede all prior agreements.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date on this page and, for significant changes, by notifying you via the app or text message. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
